Clients, contractors, architects, consultancies and investors: the success of a building project is either made or broken by the cooperation between these parties. It is paramount that all arrangements about construction and development are carefully set out in contracts.

The Construction and Property Development team of Kennedy Van der Laan will support you in drafting the most suitable building contract and is familiar with all usual contract forms and conditions used in construction, such as UAV 2012, DNR 2011, UAV-GC 2005 and ARW 2005. But even then, many things may still go wrong. Constructional problems in the execution may lead to big delays, which cause postponement of the delivery. This often has considerable financial consequences. We will act as an intermediary in conflicts and will assist you if it comes to litigation before a civil court or one of the institutes for arbitration, such as the Arbitration Board for the Building Industry in the Netherlands.
Construction and development is not possible without knowledge of spatial administrative and environmental law. We cooperate closely with the attorneys from this group. For more information about environmental law, you may consult the case law based on the Dutch Environmental Permitting General Provisions Act (“WABO”). The Building and Property Development team is also supported by the Public Procurement team, because public-sector organizations and public-private entities are often involved in building activities.
