The Public Procurement team of Kennedy Van der Laan concentrates on the tendering of various contracts for works, deliveries and services.

Tendering Procedures in Specific Sectors

The team is made up of specialized attorneys from various practice groups, which ensures that they are familiar with the sectors in which the tendering procedures take place, besides having a profound knowledge of procurement law. For example, we assist clients in the construction sector, the insurance market, the ICT sector, the public sector, the healthcare sector, and public transport.

Advice on the Full Tendering Procedure

Our knowledge enables us to offer our clients better advice on the full tendering procedure, rather than just the application of procurement law. Naturally, we are very familiar with the Dutch Public Procurement Act 2012, the Tendering Regulations for Works 2012, the Proportionality Guide, and all other laws and regulations that will enter into force in the Netherlands on 1 april 2013. For each specific tendering procedure we can offer legal support that goes beyond procurement law itself.

Procedures and Disputes concerning Tendering

The Public Procurement team supports and advises clients – contracting authorities as well as tenderers – in organizing and executing Dutch and European tendering procedures. We offer advice on all aspects of procurement law. When contracts are put out to tender, large financial interests are at stake and speed is of the essence. Disputes arising out of tendering procedures are mostly settled in preliminary relief proceedings. The attorneys of the Public Procurement team regularly defend their clients in court.

We also regularly organize courses and workshops about current developments in legislation and case law.
